How to survive an environmental inspection without fines
An inspection from the Inspectorate for Environmental Protection (WIOŚ) does not have to end with a fine of PLN 12,400, as long as the documents in the office match the state in the warehouse. Most penalties result from a mess in the papers, not from the entrepreneur's ill will. We speak plainly: the official is looking for evidence of waste flow, and we show how to prepare that evidence before they arrive.
The BDO registry and most common errors in records
Most business owners in Gdańsk only remember the BDO system when they receive a letter about a planned inspection. This system can be clunky, but errors in it cost real money, often from PLN 5,000 to even PLN 47,000 in extreme cases. During a documentation analysis for one of our metal industry clients employing 14 people, we found 83 incorrectly issued waste transfer notes. The problem was the unit of measurement – instead of tons, kilograms were entered, which suggested that the company produced a thousand times more scrap than it actually removed. Such a mistake is a signal for the inspector to impose a penalty for unreliable record-keeping, which we verified firsthand during an intervention in March 2024.
It is worth checking whether the BDO registration number is on every sales invoice and on receipts if the company serves private individuals. The lack of this number on documents from the last 6 months is the easiest reason to issue a fine on the spot. Arguments instead of emotions: the inspector will not listen to explanations about a server failure or a forgetful accountant. They need a clean waste record card for each code the company generates. If you handed over 12 containers of rubble in 2023, the system must show exactly 12 approved cards with correct collection dates by an authorized carrier.
To be honest, the BDO system is not the peak of technology, but you have to navigate it efficiently. It often happens that transports from the turn of the year, for example from December 29, are only booked in January of the following year, which creates a gap in the annual report. We recommend closing all cards by January 15 to avoid questions about lack of continuity. Waste storage – the devil is in the codes
Waste storage rules have changed significantly in recent years, and penalties for lack of information signs can reach up to PLN 2,300 for each missing label. We speak plainly: every barrel of used oil or pile of foil must have its place and clear marking. During a site visit at a small printing house near Gdynia, we noticed that hazardous waste, such as wipes soaked in chemicals (code 15 02 02*), was lying next to ordinary waste paper. An inspector during an inspection in May 2024 would certainly consider this waste mixing, which is strictly forbidden. It was enough to separate 3.2 square meters of space and place an appropriate certified container.
It is also crucial to have up-to-date decisions on waste generation, as long as their amount exceeds 1 ton per year for hazardous waste. Many manufacturing companies operate on old permits that expired after the change in fire protection regulations. If your company does not have a fire protection report for storage locations, an environmental inspection may end with an application to suspend operations. Without bureaucratic newspeak – if the storage site is not protected against leakage into the ground, no explanation about a temporary lack of funds for floor renovation will help. The official will write a protocol, and the penalty will arrive by mail within 14 days.
Sometimes companies store waste for too long, counting on better prices at the collection point. According to the law, storage can last a maximum of 3 years, but for many codes this time is much shorter. During one of our internal audits at a construction sector client, we discovered waste from 2021 that should have been removed 12 months earlier. Thanks to a quick response and ordering transport a week before the official notification from the office, we avoided the charge of illegal waste dumping. KOBiZE reports and fees for environmental use
Reporting to KOBiZE is an obligation forgotten by almost 47% of small companies in the Pomeranian region. This applies to everyone who owns at least one company car running on gasoline or diesel, or a heating boiler with a power of over 20 kW. The deadline is always at the end of February, and failure to fulfill it casts a shadow on the company's credibility during a field inspection. In 2023, we helped recover PLN 3,800 in overpaid contributions for a carpentry workshop that incorrectly calculated emissions from the paint shop, overstating solvent consumption by 23%.
It is worth knowing that environmental fees are not high for small entities, often amounting to several or several dozen zlotys per year. The problem is the very fact of the lack of a report. Inspectors often start by asking for the login and password to the KOBiZE portal to check the consistency of data with fuel invoices. If the accounting department has invoices for 12,400 liters of diesel, and the report entered half of that value, the inspection will certainly be extended by further working days. Documentation must be consistent – data from car logs must correspond to what the central system sees.

The official appreciates the fact that the company keeps an emission register on an ongoing basis, even in a simple Excel sheet, as long as the numbers match the purchase invoices. (As an aside: it is also worth checking if the air conditioning in the office requires an entry in the Central Register of Operators, because penalties for the lack of a leak test are exceptionally severe).

Attitude during inspection – how to talk to an official
Inspection day is a stress for every manager, but emotions are the worst advisor. We speak plainly: the inspector is doing their job and does not come to ruin the company, but to check compliance with the law. The worst thing you can do is lie or hide documents. During an inspection at a transport company in January 2024, the owner tried to hide the fact of having his own refueling station. The inspector noticed tracks on the asphalt and as a result, the inspection, which was supposed to last 4 hours, dragged on for 3 business days and ended with a meticulous check of every square centimeter of the base.
We recommend appointing one person to contact the office – preferably someone who actually knows the processes in the company and can quickly find an invoice for oil filter disposal or a contract with a water supplier. Arguments instead of emotions: if the inspector points out a failure, instead of arguing, it is better to ask for a specific legal basis and a deadline for submitting explanations. Most protocols can be supplemented with missing attachments within 7 or 14 days, which gives time for a quick correction of papers. Air conditioning and cooling devices (F-gases)
Devices containing refrigerants are one of the most controlled areas by environmental inspectors. If units with a CO2 equivalent of over 5 tons are installed in the office or hall, they must be registered in the Central Register of Operators (CRO). Lack of entry or failure to perform a leak test on time is a guaranteed penalty of PLN 4,000 upwards. In October 2023, we analyzed the situation at a hotel near Gdańsk, where there were 14 air conditioners. It turned out that 3 of them did not have up-to-date device cards because the service technician forgot to enter the data into the system after replacing the compressor.
It is important that the service technician who comes to your company has a current F-gas certificate. The company is obliged to check these qualifications before allowing the employee to the air conditioner. If the service is performed by an unauthorized person, the penalty falls on the owner of the device, not on the service technician. Documentation should include confirmation of refrigerant recovery or its completion with an accuracy of two decimal places (e.g., 1.25 kg). Such details build trust with the controller and show that the company is in control of its resources and does not allow uncontrolled gas leaks into the atmosphere.

Just check the dates on the service stickers and compare them with the entries in the CRO system. If you find a discrepancy, you have a chance to call the service and complete the deficiencies before the WIOŚ visit. Checking 14 air conditioners usually takes us about 2 hours and allows for savings of several thousand zlotys due to potential administrative penalties.

Contracts with waste collection companies – what the office looks at
Many companies assume that since they pay for waste collection, the responsibility for it ends when the garbage truck leaves the gate. Nothing could be further from the truth. According to the Waste Act, the producer is responsible for the waste until it is delivered to the final disposal site by a legal company. During an inspection, the inspector will always ask to see the transport decision of the company that collects waste from you. If this company lost its permit 6 months ago and you still pay it, you risk a charge of transferring waste to an unauthorized entity. This is a serious violation that cost one local transport company as much as PLN 8,300 in March 2024.
Check your contracts – are the waste codes you actually hand over recorded in them? It often happens that the contract is general, and the company has started producing a new type of waste, e.g., used toners (code 08 03 18), which are not in the annex. It is also worth verifying whether the collecting company has a BDO entry with permissions for transport and collection of specific fractions. Recently, in February 2025, we detected that one of the scrap recipients in the Gdańsk district was operating on an expired water law permit, which could have exposed our clients to complicity in a violation of environmental regulations.
Practical advice: once a quarter, download a report from the BDO system confirming the execution of waste transfer cards by the recipient. If the card hangs in the system as 'planned' for 3 months, it means that the recipient has not confirmed the acceptance of the load. For the office, this is a signal that the waste could have ended up in a forest or an illegal landfill.
